Election Commission of India in a way is the guardian of elections. As soon as the elections are declared in a state or for the centre, it starts governing the conduct of political parties to prevent any use of unfair means by anyone whether incumbent or in opposition.

Model code of conduct or aachar sanhita is thus issued.It is a set of rules and guidelines which all participants in the process are expected to follow. It applies to all political parties, the candidates and polling agents, the government in power, and all government employees and remains in force till the declaration of results.

The model code of conduct is not a statute law (not coming from the primary sources of Court rulings or Legislation), but, has a persuasive effect , as per the powers contained with election commission of India under the constitution the lack statutory backing does not prevent the commission from enforcing it. 
 
It includes stopping the incumbent party from declaring any new schemes or subsidies etc. and limiting the use of money and other influences by the candidates, use of government machinery etc.Any deviation from this behavior may attract negative reinforcement from the commission to the effect of cancellation of candidature.
